Terms of Service

1. Service Description
ONELESS is an SMS-based assistant. You send text messages to a designated number; we use AI and integrations (e.g., email, calendar, reminders) to fulfill requests and send replies. The service is provided "as is" and may change over time.
2. Service Availability and Force Majeure
ONELESS relies on third-party services including Twilio (SMS delivery), Anthropic (AI processing), Google (calendar integration), and Stripe (billing). We are not liable for service interruptions, delays, or failures caused by: outages or changes to third-party provider services; mobile carrier issues, network outages, or SMS delivery failures; natural disasters, pandemics, or other acts of force majeure; government actions or regulatory changes; or any other events beyond our reasonable control. We will make reasonable efforts to restore service promptly and notify users of extended outages.
3. Geographic Availability
ONELESS is currently available only within the United States. By using this Service, you represent that you are located in the United States. We may restrict access from other jurisdictions without notice.
4. Acceptable Use
You agree not to:
- Use the service for any illegal purpose or in violation of applicable laws
- Abuse, harass, or harm others through the service
- Use the email or messaging features to spam or send unsolicited bulk messages
- Attempt to gain unauthorized access to our systems or other users' accounts
- Resell or sublicense the service without our written permission
- Use the email feature to send messages that violate the CAN-SPAM Act, including emails with deceptive subject lines, missing sender identification, or no opt-out mechanism
- Send emails through ONELESS to recipients who have previously opted out of receiving messages from you
When you use ONELESS to send emails on your behalf, you are responsible for ensuring that the content and recipients comply with applicable laws, including the CAN-SPAM Act. ONELESS will include an unsubscribe mechanism in emails sent through the service where required by law.
We may suspend or terminate accounts that violate these terms.
5. Account Termination
We may terminate or suspend your account at any time for breach of these terms, non-payment, or at our discretion. You may cancel your subscription and stop using the service at any time. Upon termination, your right to use the service ceases; we may retain data as described in our Privacy Policy.
6. Limitation of Liability
ONELESS uses AI to interpret and act on your messages. AI-generated content may be incorrect, incomplete, or unsuitable. The service is not a substitute for professional advice (legal, medical, financial, etc.). To the maximum extent permitted by law, we disclaim all warranties and are not liable for any indirect, incidental, or consequential damages arising from your use of the service.
7. Indemnification
You agree to indemnify, defend, and hold harmless Mason Stanton Bartlett (doing business as ONELESS) and his agents, representatives, and service providers from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service in violation of these Terms; (b) your use of the email or messaging features to send unsolicited, harassing, or illegal content; (c) any content you submit through the Service that infringes on third-party rights; or (d) your violation of any applicable law or regulation.
8. SMS and Messaging Consent (TCPA)
By providing your phone number and checking the consent box at signup, you consent to receive SMS messages from ONELESS, including service replies, scheduled digests, reminders, and service-related notifications. Message frequency varies based on your usage and plan. Msg & data rates may apply. You may reply STOP at any time to opt out of non-transactional messages; after opting out, you will still receive replies to messages you send. Reply SUPPORT for support information.
Our SMS messages are sent from a toll-free number registered with U.S. mobile carriers under the brand name ONELESS.
9. Subscription and Billing
Paid plans are billed on a recurring basis (e.g., monthly) as described at signup. You may cancel at any time; cancellation will take effect at the end of the current billing period. Refunds are handled according to our refund policy (see our website or Stripe billing portal). We may change pricing with reasonable notice.
10. Intellectual Property
You retain ownership of the content you submit (messages, notes, etc.). You grant us a license to use that content as necessary to provide and improve the service. ONELESS, our logos, and our product are our intellectual property.
11. Dispute Resolution
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles.
Arbitration. Any dispute arising from these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will take place in Wyoming, or by phone or video conference at your election.
Fees. Each party bears its own arbitration fees unless the arbitrator orders otherwise. If you are unable to afford the arbitration filing fee, we will consider a good-faith request to cover it.
Small claims. Either party may bring qualifying claims in small claims court instead of arbitration.
Class action waiver. You agree to resolve disputes individually. You waive any right to participate in class action lawsuits or class-wide arbitration.
Opt-out. You may opt out of this arbitration agreement by sending written notice to support@one-less.io within 30 days of first using the Service. If you opt out, disputes will be resolved in the state or federal courts located in Wyoming.
12. Changes to Terms
We may update these terms from time to time. We will post the updated terms on this page and update the "Last updated" date. Continued use of the service after changes constitutes acceptance of the new terms. Material changes may be communicated via email or in-app notice where appropriate.
